The Lahey.org website (the "Site") is provided by Lahey Clinic, Inc., ("Lahey") and is intended to provide general educational information and to help users learn about and access a variety of health care services. Your access to this site binds you to this Agreement, so please read it carefully. Your continued use of the Site indicates your acceptance of this agreement and of these terms and conditions of use.

The provision of information on the Site is for consumer educational use only and does not constitute the practice of medicine, nursing or other professional health care service. You hereby agree that you will not reverse engineer, break into the Site, or use materials from the Site to violate the law. Permission to reprint or electronically reproduce any document or graphic in whole or in part for any other purpose is expressly prohibited, unless prior written consent is obtained from Lahey Clinic. WHILE WE TRY TO KEEP THE INFORMATION ON THE SITE AS ACCURATE AS POSSIBLE, WE DISCLAIM ANY WARRANTY REGARDING ITS ACCURACY, TIMELINESS, COMPLETENESS OR ACCURACY FOR ANY PARTICULAR PURPOSE. WE DISCLAIM ANY AND ALL WARRANTIES EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTY OF MECHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Indemnification

 
You agree to indemnify, defend and hold harmless Lahey Clinic Inc., and its affiliates, its officers, directors, employees, agents, (the "Indemnitees") from and against all losses, expenses, damages and costs, including without limitation, lost wages, revenue or business because of any information or services provided by the Site. Your sole and exclusive remedy for dissatisfaction with the services of the Site will be to stop using the Site.

Copyright and Trademarks

 
The materials on the Site are protected by copyright law. Any use of materials from the Site that is not in accordance with this Agreement is strictly prohibited.

The mark "Lahey Clinic" is a registered service mark of Lahey Clinic, Inc. Unauthorized use of this mark is strictly prohibited.

Choice of Law and Venue

 
This Agreement shall be construed in accordance with the laws of the Commonwealth of Massachusetts exclusive of its choice of law rules. Users of the Site agree to the exclusive jurisdiction of the state and federal courts sitting in Boston Massachusetts, and waive any jurisdictional, venue or inconvenient forum objections to such courts. Because the Site is for educational purposes only, you agree that it does not constitute "doing business" in any specific jurisdiction or soliciting business for Lahey or any of its affiliated entities or establishing "minimum contacts" with any jurisdiction outside the Commonwealth of Massachusetts.

Availability of Website

 
The Site is made available at the sole discretion of Lahey. Lahey reserves the right to modify or discontinue either temporarily or permanently, the Site or any part thereof without notice.

User Representations

 
Users must be at least 18 years of age or supervised by a parent or legal guardian who agrees both to this Agreement and to the minor's use of the Site.

Miscellaneous

 
Lahey Clinic's failure to enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. The provisions of this Agreement are severable. In the event that any provision hereof is held to be invalid or unenforceable, such invalidity or unenforceability shall not effect the validity or enforceability of the remaining provisions. Lahey reserves the right to modify these Terms of Use and recommends that you periodically review them. All rights not expressly granted by these Terms of Use are reserved by Lahey. This Agreement constitutes the entire agreement between Lahey and users of the Site.
